Subject: Fireworks Seizure
On June 26, 2026, the Oshkosh Police Department became aware of a fireworks stand (located in the 800 Block of N Washburn Street in the City of Oshkosh) that was possibly selling illegal fireworks in violation of the Oshkosh Municipal Code, Chapter 13-6 (C) (1). On June 27, 2026, the Oshkosh Police Department Criminal Investigation Division conducted an interdiction detail, which included an inspection of the fireworks stand and uncovered that this business was selling fireworks in violation of the municipal code. This business was selling illegal fireworks out of a separate trailer, which was parked away from the actual fireworks stand.
The Oshkosh Police Department made contact with employees who admitted to selling the fireworks from the trailer to customers in violation of our local ordinance. The illegal fireworks were seized by law enforcement. The seizure included over 600 fireworks, which are estimated to cost $29,000.
The Oshkosh Fire Department was consulted during this investigation, as no permits were granted by the Oshkosh Fire Department, Fire Marshal.
The Oshkosh Police Department is working in conjunction with the Oshkosh City Attorney’s Office to review violations of the City of Oshkosh ordinances. The investigation is still ongoing at this time.
In 2024, the Oshkosh Common Council enhanced penalties for violations of our municipal ordinance related to fireworks, including an increase in fines.
Each year, around the Fourth of July, the Oshkosh Police Department receives numerous complaints from residents regarding the illegal use of fireworks within the city. Between July 1 and July 7, 2024, Officers responded to approximately 80 calls for service related to fireworks. During the same period in 2025, the department responded to approximately 118 fireworks-related calls for service, and 26 citations were issued.
The Oshkosh Police Department will continue to conduct inspections of locations that sell fireworks to ensure that illegal fireworks are not being sold to individuals within the City of Oshkosh who do not possess a permit to buy these fireworks. Officers will also be responding to fireworks complaints to make contact with citizens to determine if a violation has occurred. If a violation has occurred, law enforcement action will occur, and fireworks found to be in violation will be seized to curtail repeat violations and ongoing problems.
Legal Fireworks: Allowed fireworks include sparklers, stationary cones and fountains, toy snakes, smoke bombs, caps, noise makers, and confetti poppers (with less than ½ grain of explosive)
Illegal Fireworks: Roman candles, firecrackers, bottle rockets, mortars, anything that explodes or leaves the ground (only individuals/ groups with a governmental issued permit are allowed these types of fireworks)
Fireworks Ordinance: City of Oshkosh Municipal Code, Chapter 13-6(C)(1) no person may sell, possess or use fireworks, as that term is defined by Wisconsin State Statute Section 167.10(1), except by an appropriate permit issued by the Fire Marshal.

For Juveniles: (not less than)
1st Offense: $100 + $5 Court Costs = $105
2nd Offense: $150 + $5 Court Costs = $155
3rd Offense: $500 + $5 Court Costs = $505

For Adults: (not less than)
1st Offense: $125 + $170 Court Costs = $295
2nd Offense: $225 + $196 Court Costs = $421
3rd Offense: $1000 + $397.50 Court Costs = $1,397.50

Fireworks maybe enjoyable, but they can also cause distress to many in our community, especially those with PTSD or noise sensitivities. Loud explosions can also have a negative effect on pets, causing them undue stress and potential harm.
